As intellectual property design right owners, Chewbz ltd has a number of exclusive rights under the copyright act of 1968 and subsequent additions under intellectual property rights law. These exclusive rights protect our product design from reproduction and communication to the public (by way of broadcast or sale). It is an infringement of both copyright and design right (under general intellectual property right law) to use either the whole or a substantial part of a third-party's work, or to authorise such an act, without the permission or licence of the copyright owner, in this case, Chewbz ltd.

Design right offers a product owner automatic protection for the internal or external shape or configuration of their design. Design right also extends protection to Chewbz ltd under law allowing us to stop anyone from copying the 'shape' or 'configuration' of our products. This does not offer protection for any of the 2-dimensional aspects of the design, for example the label, which is protected separately under copyright. Chewbz ltd's design right extends 10 years after the first marketing of our products that use the design. For the first 5 years of this period we are afforded the right to stop anyone from copying the design. For the rest of this period the design is subject to a license of right.

Furthermore, design right offers a legal right to protect the overall visual appearance of our products in the geographical area in which it is registered (the uk). As outlined in intellectual property right law, the visual features that form a design include such things as the lines, contours, colours, shape, texture, materials and the ornamentation of the product which, when applied to the product, give it a 'unique appearance'. It is clear that the proposition offered by Chewbz ltd in our products is based around this 'unique appearance' via our design of colour, shape, material and ornamentation. Design right allows a work's owner to stop others from creating designs which are too similar within the same geographical area in which they have protected their designs (in this case the uk).

If our protected intellectual property is found to be used without permission we will take such action in order to protect our rights including, without limitation, legal action for injunctive relief or to recover damages. This may happen without notice to the third party we deem responsible for any such breach.
